This document waives important legal rights. Read it carefully before signing. In consideration for my membership in the GOHJA and for the purpose of my participation in any GOHJA sanctioned activity, including, but not limited to GOHJA sanctioned competitions, I agree to the following: (1) I choose to participate voluntarily in the GOHJA and/or GOHJA sanctioned activity with my horse, as a rider, handler, lessee, owner, agent, coach, trainer and/or as the parent/guardian of a junior exhibitor. (2) I am fully aware and acknowledge that equine sports, including GOHJA sanctioned competitions, involve inherent dangerous risks of accident, loss, and serious bodily injury including broken bones, head injuries, trauma, pain, suffering or death (“Harm” and or loss of any kind). (3) I expressly release the GOHJA, Clarcona Horseman’s Park and the Management/Staff of any GOHJA sanctioned competition from all claims for monetary damages or otherwise from any Harm to me or my horse and for any Harm caused by me or my horse to others, even if the Harm resulted, directly or indirectly, from the negligence the GOHJA, Clarcona Horseman’s Park or the Management/Staff of any GOHJA sanctioned competition. (4) I expressly assume all risks of Harm to me or my horse, including Harm resulting from the negligence of the GOHJA, Clarcona Horseman’s Park or the Management/Staff of any GOHJA sanctioned competition. (5) I agree to indemnify (that is, to pay any losses, damages, or costs incurred by) the GOHJA, Clarcona Horseman’s Park and the Management/Staff of any GOHJA sanctioned competition and to hold them harmless with respect to claims for Harm to me or my horse, and for claims made by others for any Harm caused by me or my horse at any GOHJA sanctioned activity. (6) I have read the GOHJA Rules about protective equipment and I understand that I am entitled to wear protective equipment without penalty, and I acknowledge that the GOHJA strongly encourages me that I do so. (7) I understand that under Florida law an equine activity sponsor or equine professional is not liable for an injury to, or death of, a participant in equine activities resulting from the inherent risk of equine activities. (8) I shall be subject to, and bound by, the Constitution, Bylaws and Rules of the GOHJA, the USEF Clarcona Horseman’s Park and the specific rules of any GOHJA sanctioned competition, and will accept as final the decision of the GOHJA Hearings Committee on any question arising under said Rules and agree to hold the GOHJA, the USEF, Clarcona Horseman’s Park, and the Management/Staff of any GOHJA sanctioned competition harmless for any action taken under the above rules. (9) The GOHJA, Clarcona Horseman’s Park and/or the Management/Staff of any GOHJA sanctioned competition may use or assign photographs, videos, audios, cablecasts, or other likenesses of me and my horse taken during the course of a GOHJA sanctioned activity for promotion, coverage or benefit of the activity, sport or the GOHJA. Those likenesses shall not be used to advertise a product and they may not be used in such a way as to jeopardize Amateur Status. I hereby expressly and irrevocably waive and release any rights in connection with such use, including any claim to compensation, invasion of privacy, the right of publicity, or to misappropriation. (10) The construction and application of the GOHJA Rules are governed by the laws of the State of Florida and any action instituted against the GOHJA must be filed in Florida. (11) The GOHJA, Clarcona Horseman’s Park and the Management/Staff of any GOHJA sanctioned competition, as used above, includes all of their officials, officers, directors, employees, agents, personnel, volunteers and affiliated organizations. (12) If I am the parent or legal guardian of a minor child, I consent to the child’s participation and agree to all of the above provisions and assume all of the obligations of this Release and Agreement on the child’s behalf. A Signature is required for each Member. The parent or Legal Guardian must sign for minor members. Trainers or Barn Managers have not authorized signers. Riders mounted before paramedics arrive ride at their own risk.
